The primary sector is critical to New Zealand's growth. The sector makes up over 75 percent of New Zealand's merchandise exports and primary industries are the largest user of New Zealand's natural resources. The Ministry for Primary Industries is focussed on “growing and protecting New Zealand.” As such MPI plays an important role, as a regulator and advisor, in helping maximise export opportunities for our primary industries, improving sector productivity, ensuring the food we produce is safe, increasing sustainable resource use, and protecting New Zealand from biological risk. In helping to achieve this MPI works with primary industries and other government agencies across a range of areas, including agriculture, fisheries, trade, food, and biosecurity.
We are looking for an Intermediate or Senior Prosecutor to join our highly skilled but very collegial Prosecutions Team, which is responsible for the provision of specialised, high quality, practical legal advice and prosecution services in respect of a wide array of matters where non-compliance of the legislation that MPI administers is identified. This may involve matters pertaining to the welfare of animals on farms, recreational and commercial fishing breaches, the illegal milling of trees, the production and sale of non-compliant food and animal products, to the import of unwanted pests and organisms at the border, to name but a few.
You will have excellent written and oral skills and be able to communicate with clients clearly, precisely, and appropriately, both orally and in writing. Your legal advice will be well-researched, contextualised and solution orientated and with options for managing any legal risk identified. You will also need to have good interpersonal skills, as being able to work collaboratively with colleagues as well as being able to build and maintain effective professional working relationships with clients across MPI's branded business units, are critical components of the role.
As a Prosecutor a core part of the job will involve you conducting the Ministry's criminal prosecutions in the District Court in accordance with relevant policy and legislation. You will also work closely with the Crown Solicitor network and Crown Law on more complex cases and appeals. The Ministry prides itself on being a model litigant and you will be required to exercise sound judgment and professional integrity at all times. The types of matters that you may be required to appear on range from simple sentencings and pre-trial hearings, to complex sentencings and Judge-Alone trials involving category 2 and category 3 offences. For this you will ideally have completed relevant litigation skills training, have a good level of trial experience, and have experience in mentoring and supervising others such that would enable you to meet, either immediately or within a short space of time, the criteria for Level 4 prosecutor classification as set by Crown Law for departmental prosecutors.
As part of the wider Legal Services Directorate you will also have other responsibilities that may involve you advising on the interpretation of statutory provisions and new legislation, doing opinion work on wider issues, providing legal advice on OIA requests, and supporting and providing training to frontline staff.
The role is based in the Ministry's Petone office. However, from time to time some domestic travel may be required.
You must have a current driver's licence and a current practising certificate (or be eligible to obtain one).
